QH8 Technologies Platform Terms

1. Ownership of Platform Materials

QH8 Technologies owns all right, title, and interest in and to the QH8 platform, including the QH8 Asset Passport structure, Return Shield workflow, Seller Protection Layer, evidence processing methods, verification page format, dashboard layouts, report templates, PDF Evidence Brief formatting, documentation, user interface structure, software code, technical logic, scoring methods, evidence classification methods, and related platform materials.

Customer data, transaction data, uploaded evidence, order information, item identifiers, shipment records, and return records submitted by the customer remain the customer's business data. QH8 Technologies does not claim ownership of customer-submitted business evidence.

2. Permitted Use

The platform may be used only for legitimate business evidence capture, shipment documentation, asset-passport creation, return review, internal merchant review, marketplace response, chargeback response, carrier review, insurance review, and related operational evidence purposes.

QH8 Evidence Briefs, verification pages, reports, QR records, and exported materials may be used for review and submission in connection with the customer's own transactions and disputes.

3. Reverse Engineering and Competitive Use Prohibited

Users may not, directly or indirectly:

a. reverse engineer, decompile, disassemble, copy, scrape, or attempt to derive the source code, architecture, data model, scoring logic, evidence rules, verification logic, report structure, or underlying technical methods of the QH8 platform;

b. copy, reproduce, modify, imitate, or create derivative works based on the QH8 platform, workflows, report formats, verification pages, dashboard layouts, or evidence processing structure;

c. use access to the QH8 platform, reports, outputs, APIs, screenshots, layouts, or documentation to build, train, assist, benchmark, or improve a competing product, service, software platform, evidence registry, fraud-prevention tool, chargeback tool, return-protection system, or verification product;

d. scrape, harvest, bulk-download, automate extraction from, or systematically collect QH8 reports, verification pages, dashboard content, public records, field structures, or PDF formats except as expressly permitted for the customer's own legitimate business records;

e. remove, alter, obscure, or misrepresent QH8 copyright notices, trademarks, verification marks, report identifiers, QR records, or platform attribution.

4. Automated Access, Bots, Scraping, and Abuse Monitoring

Users may not use bots, crawlers, scrapers, scripts, automated browsers, headless browsers, API automation, bulk download tools, credential-stuffing tools, vulnerability scanners, or similar automated systems to access, copy, test, enumerate, reverse engineer, monitor, overload, or extract information from the QH8 dashboard, login pages, signup pages, verification URLs, APIs, reports, PDF links, QR records, or backend endpoints, except where QH8 has expressly authorized such access in writing.

QH8 Technologies may monitor account telemetry, request patterns, login attempts, IP addresses, user agents, API calls, verification-page access, dashboard behavior, rate-limit activity, file access, and related security signals to detect misuse, scraping, cloning attempts, abuse, unauthorized automation, or violations of these Terms. QH8 may rate limit, block, suspend, terminate, or investigate accounts or traffic that appear abusive, automated, unauthorized, or inconsistent with legitimate customer use.

5. Report and Output Restrictions

QH8 Evidence Briefs, Asset Passport records, Return Shield reports, QR verification pages, and exported evidence packets are generated for the customer's own transaction review and evidence submission purposes.

The format, structure, layout, wording, field sequence, evidence matrix design, verification flow, and report presentation are proprietary QH8 Technologies materials. Customers may submit QH8-generated reports for legitimate transaction, marketplace, chargeback, carrier, insurance, or legal review, but may not copy or reuse the report format to create a competing system.

6. Integrity and False Evidence

Users may not submit false, altered, misleading, fabricated, or unauthorized evidence through the platform. QH8 Technologies may suspend or terminate accounts that submit fraudulent records, attempt to manipulate evidence results, abuse the platform, or use the platform in violation of these Terms.

7. No Legal, Refund, or Payment Decision

QH8 Technologies provides technical evidence records, comparison reports, verification tools, and evidence review materials. QH8 does not decide refund outcomes, payment release, marketplace liability, carrier liability, insurance coverage, legal responsibility, buyer intent, seller fault, or final dispute outcomes. Final decisions remain with the relevant merchant, marketplace, bank, payment processor, carrier, insurer, regulator, court, or contracting party.

8. Limitation of Liability

To the maximum extent permitted by law, the QH8 platform, dashboards, verification pages, reports, APIs, QR links, PDF generation, image handling, camera/OCR features, scanner features, scale integrations, carrier data features, and related services are provided on an "as-is" and "as-available" basis. QH8 Technologies does not guarantee that the platform will be uninterrupted, error-free, continuously available, compatible with every device, accepted by any third party, or free from delays, hosting outages, file-access issues, image-loading issues, browser permission issues, PDF-generation issues, third-party service issues, or data-transmission problems.

To the maximum extent permitted by law, QH8 Technologies shall not be liable for any indirect, incidental, special, consequential, punitive, exemplary, or similar damages, or for any loss of profits, revenues, business, goodwill, data, item value, chargeback amount, refund amount, marketplace account standing, payment reserve, carrier claim, insurance claim, or third-party dispute outcome, whether incurred directly or indirectly, resulting from access to, use of, inability to use, or reliance on the platform or any QH8-generated report, verification page, QR record, Evidence Brief, Asset Passport, Return Shield comparison, PDF, API response, or related service.

In no event shall the aggregate liability of QH8 Technologies for all claims relating to the platform, customer account, QH8 transaction credit, Asset Passport, Return Shield check, Evidence Brief, verification page, report, API call, or related service exceed the amount actually paid by the customer to QH8 Technologies for the specific QH8 transaction credit, passport, return check, report, or service event giving rise to the claim, or USD 100, whichever is greater. Nothing in these Terms limits liability where such limitation is prohibited by applicable law.

9. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States of America, without regard to conflict-of-law provisions. Any dispute, claim, or controversy arising out of or relating to these Terms, the QH8 platform, customer access, platform outputs, evidence records, reports, verification pages, account activity, customer use, or any QH8-generated output shall be resolved exclusively in the state or federal courts located in the State of Delaware, United States.

Notwithstanding the foregoing, QH8 Technologies may seek injunctive, emergency, or protective relief in any competent jurisdiction to prevent or stop unauthorized copying, scraping, reverse engineering, automated extraction, misuse, infringement, or misappropriation of QH8 intellectual property, trade secrets, platform systems, or confidential technical materials.

10. Enforcement

Any unauthorized copying, reverse engineering, scraping, automated extraction, imitation, competitive use, abuse, or misuse of the QH8 platform or its outputs may result in immediate account suspension or termination. QH8 Technologies reserves all rights and remedies available under applicable copyright, trademark, trade secret, contract, unfair competition, computer misuse, and related laws.
